Terms of Use Agreement

1. 🌟 Introduction & Acceptance

Welcome to simmmy! These Terms of Use ("Terms" or "Agreement") govern your access to and use of the simmmy mobile application, website at www.simmmy.com, and all related services (collectively, the "Service"), operated by simmmy Inc. ("simmmy," "we," "us," "our").

By creating a simmmy account, downloading the app, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Cookie Policy, and Community Guidelines, all incorporated herein by reference.

These Terms apply to all users of the Service, regardless of registration status, subscription level, or region.

2. ✅ Account Eligibility & Responsibilities

Eligibility Requirements

To use simmmy, you must:

• Be at least 18 years of age
• Be a natural person (not a company, bot, or automated system)
• Be legally eligible to enter a binding contract in your jurisdiction
• Not be located in a country subject to applicable trade embargoes or sanctions
• Not have been previously banned from simmmy for a violation of these Terms
• Not have been convicted of a violent crime, sex crime, or similar serious offence
• Not be required to register as a sex offender in any jurisdiction

Account Responsibilities

You agree to:

• Create only one account and keep your information accurate and up to date
• Use a strong password and keep your login credentials confidential
• Not share your account with anyone else or allow others to access it
• Notify us immediately if you believe your account has been compromised
• Represent yourself honestly — use real photos of yourself, not AI-generated images
• Engage with other users respectfully and in good faith
• Comply with these Terms and all applicable laws

Seeking Genuine Connection

simmmy is designed for people genuinely seeking meaningful relationships, friendships, or social connections. Using simmmy for commercial solicitation, political campaigning, spam, scams, or any purpose other than genuine human connection is prohibited and will result in immediate account termination.

3. 📸 Content Rules

Your Content

You are solely responsible for all content you post, upload, or share on simmmy ("Your Content"). By uploading content, you grant simmmy a worldwide, non-exclusive, royalty-free licence to host, display, and use Your Content solely to provide and improve the Service.

Your Content must not:

• Include nudity, explicit sexual content, or graphic violence
• Feature anyone under 18, even non-sexually
• Misrepresent your identity, age, or appearance
• Include another person's private information without their consent
• Infringe third-party intellectual property rights
• Be generated by AI systems in a way that deceives other users about your identity
• Contain spam, commercial solicitations, or pyramid scheme material
• Promote self-harm, eating disorders, dangerous challenges, or extremist content
• Be defamatory, harassing, threatening, or discriminatory

simmmy's Rights Over Content

simmmy reserves the right to review, moderate, edit, remove, or restrict any content at any time without notice, at our sole discretion. We are not obligated to review all content but take violations seriously and act on reports promptly.

4. ✨ Cosmic Matching Services

simmmy's matching engine uses a combination of astrology, tarot archetypes, numerology, psychology, and AI analysis to suggest compatible matches. This is one of the most distinctive parts of what we offer.

By using simmmy's cosmic features, you acknowledge that:

• Compatibility scores are calculated by algorithms and are not infallible predictions
• Astrological, tarot, and numerological analysis is interpretive and not scientifically deterministic
• No dating app, including simmmy, can guarantee romantic compatibility or relationship success
• You remain responsible for your own choices in relationships
• Birth time and location data you provide will be used to generate your cosmic profile

We continually refine our matching algorithms based on aggregated, anonymised user outcomes to improve accuracy and your experience.

5. 💳 Purchases & Subscriptions

Free and Premium Services

simmmy offers both a free tier and paid "simmmy Premium" subscription plans. The free tier includes basic matching, profile creation, and limited messaging. Premium features include unlimited matches, full compatibility reports, daily tarot readings, moon phase guidance, and event access.

Automatic Renewal

Premium subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged at the rate disclosed at the time of purchase.

Cancellation

You may cancel your subscription at any time through:

• iOS: App Store > Subscriptions > simmmy > Cancel
• Android: Google Play > Subscriptions > simmmy > Cancel
• Web: Account Settings > Manage Subscription > Cancel

Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial periods, except where required by applicable law.

Refunds

All purchases are generally final and non-refundable. Exceptions apply in the following jurisdictions:

• EU/EEA/UK: Full refund within 14 days of first subscription under the Consumer Rights Directive
• California, New York, and other US states: Right to cancel within 3 business days of subscribing
• Australia: Refunds available where required under the Australian Consumer Law

To request a refund, contact billing@simmmy.com with your order number and reason.

Virtual Items

Virtual items (e.g., boosts, super likes, cosmic credits) are non-transferable and non-refundable. They have no monetary value outside of simmmy and expire if your account is terminated.

Price Changes

We may change subscription prices. We will notify you at least 30 days before any price increase takes effect and give you the opportunity to cancel.

6. 🛡️ Safety & Prohibited Conduct

simmmy is committed to being a safe, respectful space for genuine connections. The following conduct is strictly prohibited:

• Harassing, threatening, intimidating, or stalking any user
• Soliciting money, financial information, or gifts from other users
• Catfishing or creating fake profiles to deceive others
• Using the platform to facilitate prostitution or escort services
• Scraping, crawling, or bulk downloading user data
• Using automated bots or scripts to interact with the Service
• Reverse engineering or attempting to extract our source code or algorithms
• Creating multiple accounts after being banned
• Using simmmy to coordinate or facilitate illegal activity
• Sending unsolicited sexual messages or images

Reporting

You can report any user, message, or content directly within the app by pressing "Report" on their profile. All reports are reviewed by our Trust & Safety team within 24 hours. We take action on all verified violations.

No Background Checks

simmmy performs profile verification but does not conduct comprehensive criminal background checks on all users. You are responsible for exercising caution when interacting with others online and offline. Always follow our Safety Tips and meet in public places.

7. ©️ Intellectual Property

The simmmy name, logo, app design, cosmic matching system, website content, and all related intellectual property are owned exclusively by simmmy Inc. and protected by copyright, trademark, and other applicable laws.

You are granted a limited, personal, non-transferable, non-sublicensable, revocable licence to use the Service solely for its intended purpose. This licence does not grant you ownership of any simmmy IP.

If you believe any content on simmmy infringes your copyright, please contact us at copyright@simmmy.com with full details of the alleged infringement.

8. 🔒 Privacy

Your privacy is important to us. Our collection and use of your personal data, including your cosmic profile data, is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using simmmy, you agree to our Privacy Policy.

9. ❌ Account Termination

By You

You may delete your account at any time through Settings > Account > Delete Account. Upon deletion, your profile is removed from public view immediately, and your data is deleted according to our data retention policy.

By simmmy

simmmy reserves the right to suspend or terminate your account at any time, without notice, if we reasonably believe you have violated these Terms, engaged in harmful conduct, or for any other reason in our sole discretion. Termination is not subject to refund.

Effect of Termination

Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will continue to apply.

11. ⚠️ Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW. simmmy DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

simmmy MAKES NO GUARANTEE REGARDING THE NUMBER OF ACTIVE USERS, THE QUALITY OF MATCHES, OR THE ROMANTIC, SOCIAL, OR COMMERCIAL OUTCOMES OF USING THE SERVICE. COSMIC COMPATIBILITY SCORES ARE PROVIDED FOR PERSONAL ENRICHMENT PURPOSES AND DO NOT CONSTITUTE GUARANTEES OF RELATIONSHIP SUCCESS.

12. ⚖️ Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, simmmy'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO simmmy IN THE 12 MONTHS PRECEDING THE CLAIM.

simmmy IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain limitations on liability, so the above may not apply to you in full.

13. ⚡ Dispute Resolution

Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at legal@simmmy.com and give us 60 days to attempt to resolve the issue informally.

Arbitration (US Users)

If informal resolution fails, disputes between you and simmmy (for US users) will be resolved through binding individual arbitration, not through class action litigation or jury trial, except for individual claims in small claims court. Arbitration proceedings will be conducted under the rules of the American Arbitration Association (AAA).

Class Action Waiver

YOU AND simmmy EACH WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION. DISPUTES MUST BE BROUGHT INDIVIDUALLY.

EEA/UK Users

Users in the EEA and UK may bring claims before courts in their country of residence. We do not require EEA/UK users to submit to mandatory arbitration. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

14. 🏛️ Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles, except where mandatory consumer protection laws in your jurisdiction require otherwise.

For users in the EEA and UK, local mandatory consumer protection laws apply alongside these Terms and take precedence where there is a conflict.

15. 🔄 Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email and/or in-app notification at least 30 days before they take effect. Your continued use of simmmy after changes take effect constitutes acceptance of the updated Terms.

If you disagree with any changes, you must stop using the Service and delete your account before the effective date.
